Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Finova web application and related services (the "Service") operated by Finova("Finova", "we", "us", "our"). By creating an account, subscribing to a plan, or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who you are contracting with

You are contracting with Finova, the provider of the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you are using the Service as an individual, you represent that you are of legal age in your jurisdiction.

2. The Service

Finova is a personal and business finance platform that helps users manage income and expenses, accounts, savings goals, savings circles (xitique), subscriptions and reports. Available features depend on the plan you subscribe to (Personal or Business).

3. Your account

  • You must provide accurate information when you sign up and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us promptly if you suspect unauthorised access to your account.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, misleading or infringing purpose.
  • Send spam, malware, or other harmful code, or attempt to gain unauthorised access to the Service, other accounts, or the underlying systems.
  • Probe, scan, scrape, or otherwise interfere with the security, integrity, or availability of the Service.
  • Infringe the intellectual property or privacy rights of any third party.
  • Reverse engineer, decompile, resell, or redistribute the Service, except as expressly permitted by law.

5. Intellectual property

Finova and its licensors retain all right, title and interest in and to the Service, including all software, documentation, branding, designs and content made available through it. Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You retain ownership of the financial data and content you submit; you grant us a limited licence to host and process it solely to provide the Service to you.

6. Subscriptions and payments

Access to paid features requires an active subscription. Subscription plans, their prices and their billing intervals (monthly or yearly) are shown on our pricing page.

Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. This means that Paddle — not Finova — is legally the seller of the subscription to you and is responsible for the checkout, payment processing, invoicing, tax collection and remittance, billing enquiries, and refund handling. For the payment, billing, tax, cancellation and refund mechanics of your subscription, please refer to the Paddle Checkout Buyer Terms.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period. Trials, where offered, are limited to one per customer and automatically expire on the date shown at signup.

7. Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, if:

  • You materially breach these Terms;
  • Your payment for the Service fails and is not resolved within a reasonable time;
  • We reasonably believe your account presents a security, fraud, or legal risk; or
  • You repeatedly or seriously violate our acceptable-use rules.

You may terminate these Terms at any time by cancelling your subscription and deleting your account. On termination, your right to access the Service ends; you may request an export of your data within a reasonable window before the account is deleted.

8. Service availability

We work hard to keep the Service running smoothly, but we do not guarantee that the Service will be uninterrupted, error-free, or free from delays or defects. We may modify, suspend, or discontinue features from time to time to improve the Service.

9. Disclaimers

The Service and any content, insights, or recommendations shown in it are provided for general informational and personal-productivity purposes and do not constitute financial, investment, legal or tax advice. To the fullest extent permitted by law, Finova disclaims all implied warranties, including implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the extent permitted by law, Finova will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our aggregate liability arising out of or in connection with the Service will not exceed the amounts paid by you to Paddle for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or personal injury caused by negligence.

11. Indemnity

You agree to indemnify and hold Finova harmless from any claims, damages or expenses arising out of your content, your use of the Service in breach of these Terms, or your violation of applicable law or third-party rights.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, notify you in the Service or by email. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Finova is established, without regard to conflict-of-laws principles. The courts of that jurisdiction have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms, unless mandatory local consumer law provides otherwise.
